What This Means (2024 FDD)
According to the 2024 Burros Fries Franchise Disclosure Document, Burros Fries retains the right to modify the brand's Names and Marks. As stated in the agreement, Burros Fries reserves the right to substitute different Names and Marks for use in identifying the System, the Business and other Franchised Businesses operating there under.
As a result, Burros Fries franchisees must comply with any directions from Burros Fries to discontinue, modify, substitute, or add Names and Marks. Franchisees are responsible for covering the expenses associated with these changes.
Burros Fries does not guarantee that modifications or discontinuances of Names and Marks will not be required, and the company assumes no liability to the franchisee should such changes be necessary. This clause highlights the potential for brand evolution and the franchisee's obligation to adapt to these changes at their own cost, which is a fairly standard practice in franchising.
