Any rights not expressly granted to you are reserved to us. Such rights reserved to us include, but are not limited to:
- (6) Own and/or operate ourselves or authorize others to own and/or operate (a) any business located outside the Territory Location as designated on your Franchise Agreement, whether or not using the Marks and/or System, (b) any business anywhere, whether using the Marks and /or System or not, which is not substantially similar to the business franchised to you under the Franchise Agreement and/or (c) any business anywhere which does not use the Marks; and

According to Burros Fries's 2024 Franchise Disclosure Document, Burros Fries retains significant rights regarding other businesses and distribution channels. Specifically, Burros Fries reserves the right to own and operate, or authorize others to own and operate, any business anywhere that is not substantially similar to the franchised Burros Fries business. This means that Burros Fries could potentially engage in ventures that, while perhaps related to the food industry, do not directly compete with the franchisee's core Burros Fries outlet.

Furthermore, Burros Fries reserves the right to develop and distribute proprietary products and kitchen equipment branded with their mark or logo through any outlet located anywhere, including supermarkets, specialty food stores, discount club chains, retail stores, over the Internet, and similar venues. Franchisees will not receive compensation from these sales inside their territory or location, unless otherwise agreed in writing. This could impact a franchisee's revenue if Burros Fries branded products are sold in other channels within the franchisee's territory.
