Note 5: You are required to use specific point of sale ("POS" or "POS system") software for the operation of your Business. The POS software is specific to our business and tracks various aspects and provides reporting functionality. The POS support fee is for the usage of such software in addition to ongoing software support which is currently $130-$140 per month per cash register. This fee is payable to our approved vendor. It is your responsibility to install and upgrade the POS system, networking and software for your Business. We may change the technology requirements upon ninety (90) days' written notice to you and you will be required to adhere to our

new technology requirements at your own expense. Technology fees are non-refundable and are uniformly imposed and collected only by us, our affiliates, or our approved vendors (Franchise Agreement Section 10.E).
