ed to us or inspections made by us. We will furnish to you such guidance and assistance in connection with the operation of your Business, as we deem appropriate. Such guidance and advice will include methods and operating procedures utilized by our affiliates. with regards to: ingredients, recipes, menu items (including food preparation), products, services, supplies using and maintaining kitchen equipment; leasing and/or purchasing guidelines, marketing strategies, efficiencies to manage high volume, guest service standards, hiring and training employees, general operating procedures, record keeping, accounting and inventory control methods. You must pay all costs and expenses associated with these items. Additional guidance and assistance may be made available to you at your written request and in our sole discretion at fees and charges established by us (Franchise Agreement, Sections 12.J, 20.A and 20.E).

  • Operations Manual, which may include one or more manuals and other written materials for the operation of your Business containing mandatory and suggested specifications, standards and operating procedures required by us and information relative to your other obligations under the Franchise Agreement. We have the right to add to, and otherwise modify, the Operations Manual to reflect changes in authorized products (including recipes and menu items), supplies, kitchen equipment and services, as well as changes in specifications, standards and operating procedures. You must keep the Operations Manual confidential and current, and may not copy or distribute any part of the Operations Manual. The Operations Manual contains 260 pages and the current table of contents as of our last fiscal year end is included with this Disclosure Document as Exhibit D (Franchise Agreement, Section 20.G).

  • (13) Deliver to you a web page for your Franchise operations that may include portals online for additional training templates for advertising materials to support your Business and our Communications (Franchise Agreement, Sections 9.A and 20.B).
  • (14) Approve or disapprove samples of all local advertising and promotional materials not prepared or previously approved by us which are submitted by you (Franchise Agreement, Sections 12.L, 20.A and 20.J).
  • (15) Provide pre-opening or grand opening assistance to you and your staff at your Business. Such assistance will be provided to you as part of our initial franchise training program and at our cost (Franchise Agreement Section 20.A).

During your operation of the Business, we may:

  • (1) Provide additional on-site supervision and assistance as we deem necessary and in our discretion. Additional visits are for the purpose of advising you with respect to food preparation, menu items, products, services, kitchen equipment operation, customer service, operational, sales and marketing matters and personnel issues related to your Business. You will be responsible for the transportation, room and board and miscellaneous expenses incurred by our personnel during the visits, which will take place per the terms of the Franchise Agreement, or at your request, and at times and dates selected by us (Franchise Agreement, Section 20.A).
  • (2) Monitor the operation of your Business and inspect the inventory of products, supplies and kitchen equipment at your Business then advise you of the results for each inspection, at our cost.

During the operation of the Burros Fries business, the company will continue to consult with franchisees at no additional charge regarding policies, approved products, menu and retail items, supplies, food preparation and presentation, kitchen equipment, vendor and supplier relationships, industry developments, sales, advertising, marketing and promotion strategies. Burros Fries will also provide assistance to resolve operational problems that franchisees may encounter outside the scope of the Operations Manual. Franchisees will also receive updated and written lists of approved products, menu items, retail items, supplies, kitchen equipment, and services authorized for use and sale in their business, as well as updated lists of approved vendors and suppliers.

Burros Fries will also provide suggested pricing for all menu items and retail items, and may establish minimum and maximum prices to the extent allowed by law. Franchisees will receive updated and approved recipes, food preparation, and presentation standards, though they are responsible for purchasing all necessary ingredients and products for implementation. Additionally, Burros Fries offers a telephone hotline, free of charge, to answer questions from franchisees or their staff during regular business hours in the Pacific Time Zone, providing a direct line for questions, suggestions, and guidance.
