What This Means (2024 FDD)

According to Burros Fries's 2024 Franchise Disclosure Document, if a Franchisee Advisory Council is formed, its membership will be national in scope. This means that franchisees from all across the country would be eligible to participate and provide advice on System Advertising Fund usage and advertising policies. However, Burros Fries retains all operational and decision-making authority regarding advertising, and the Advisory Council's role is purely advisory.

This national scope implies that franchisees from different regions may have the opportunity to collaborate and share insights on advertising strategies that work best in their respective markets. It also means that the council's recommendations would likely reflect a broader perspective, taking into account the diverse customer base and market conditions across the nation.

It's important to note that Burros Fries has the power to select and approve the members of the Advisory Council, as well as to form, change, dissolve, or merge the council as they see fit. This gives Burros Fries significant control over the council's composition and activities. Additionally, neither Burros Fries nor the Franchise Advisory Council is obligated to ensure that expenditures by the Fund in any geographic area are proportionate to contributions from franchises in that area.

Prospective franchisees should be aware that the establishment of a Franchisee Advisory Council is not guaranteed, and its formation is at the discretion of Burros Fries. If a council is formed, its primary purpose is to advise on System Advertising Fund usage and advertising policies, but the ultimate decision-making authority remains with Burros Fries.
