What This Means (2024 FDD)
The 2024 Burros Fries Franchise Disclosure Document does not explicitly state how a franchisee will be notified if another franchise agreement expires or is terminated. However, the document does state that upon termination or expiration of the Franchise Agreement, the franchisee is not allowed to notify their guests of the termination or expiration without prior written consent from Burros Fries. Instead, Burros Fries retains the sole right to notify the franchisee's guests in a manner they deem appropriate.
This suggests that Burros Fries maintains control over communication regarding franchise terminations or expirations, particularly concerning notifications to customers. The FDD also states that former franchisees may have the ability to compete unfairly with the franchisee.
To gain clarity, a prospective Burros Fries franchisee should ask the franchisor about the specific procedures for notifying franchisees about the expiration or termination of other franchise agreements, especially those within their vicinity. Understanding this process is crucial for assessing potential competitive impacts and managing customer relationships effectively.
