What This Means (2024 FDD)
According to Burros Fries's 2024 Franchise Disclosure Document, neither Burros Fries nor its employees possess special expertise in site selection. The FDD states that any site approval is only to indicate that the proposed site meets the minimum criteria based upon general business experience. Burros Fries makes no representations that a business will be profitable or successful at an approved location.
As a prospective franchisee, it is your responsibility to locate, obtain, and occupy a suitable site for your Burros Fries business. You must also negotiate the lease at your own expense. Burros Fries provides written guidelines for site selection, and you must select a site within the protected territory outlined in the Franchise Agreement. Before signing a lease or investing money in a site, you must obtain written approval from Burros Fries.
Burros Fries will evaluate the proposed site based on factors such as population density, demographics, traffic patterns, convenience, parking, safety, zoning ordinances, and the physical characteristics of the premises. They will then notify you of their decision within 30 days of receiving your request. If Burros Fries does not approve the site, you will have a second opportunity to find an acceptable location. Failure to have a site approved after the second attempt may result in the termination of the franchise agreement.
Given that Burros Fries does not claim special expertise in site selection, prospective franchisees should conduct thorough market research and due diligence to assess the suitability of any potential location. This may involve consulting with real estate professionals, analyzing local market conditions, and evaluating the competitive landscape to ensure the chosen site offers the best possible chance for success.
