What This Means (2024 FDD)
According to Burros Fries's 2024 Franchise Disclosure Document, the trade dress includes the decoration and outfitting of the Burros Fries business, encompassing specific kitchen equipment, furnishings, fixtures, décor items, and signage. Burros Fries emphasizes that they have invested significant time in designing these elements.
As a result, franchisees are required to purchase these items from Burros Fries, its affiliates, or approved vendors, as detailed in the Operations Manual and Section 12.T of the Franchise Agreement. This requirement ensures uniformity and maintains the consistent high quality of products and services across all franchised businesses.
Failure to comply with these purchasing requirements and using unapproved items may lead to the termination of the Franchise Agreement, as specified in Section 23.C. The franchisor retains sole discretion in approving vendors and suppliers, considering factors such as price, quality, design, safety, and the supplier's ability to meet the franchisee's needs effectively.
