What This Means (2024 FDD)

According to Burros Fries' 2024 Franchise Disclosure Document, the franchisee can sell Burros & Fries labeled and branded products and kitchen equipment to anyone located anywhere, including within their territory. However, this is only allowed if it's done through channels other than operating a Burros & Fries Business within their territory. This means a franchisee could potentially sell products online or through other distribution methods outside of their physical restaurant location.

This condition allows Burros Fries to explore alternative revenue streams without directly competing with the franchisee's primary business. It also reserves the right for Burros Fries to develop and sell products through other channels, potentially creating additional brand awareness and revenue for the company as a whole.

However, the franchisee is restricted from independently marketing on the Internet or conducting e-commerce without written consent from Burros Fries. This restriction ensures that Burros Fries maintains control over its online presence and brand image, and prevents franchisees from potentially undercutting the franchisor's own online sales efforts. Prospective franchisees should clarify with Burros Fries the specific conditions under which they might be allowed to engage in online marketing and e-commerce activities to supplement their business.
