WHEREAS, We have devised a uniform system for the establishment and operation of a Burros & Fries restaurant that serves a variety of sandwiches, plates and salads and beverages (such as carbonated drinks, juices, teas and bottled water) for lunch and dinner and made fresh daily using proprietary recipes with an operational emphasis on quality and superior service (the "System") either within a shopping center or free-standing structure. You may sell novelty items and other products approved by us (hereinafter referred to as "Products"), as well as offering catering services (the "Services") (hereinafter referred to as the "Business," "Franchise Business," "Franchised Business," "Franchise" or "Burros & Fries Restaurant;"

What This Means (2024 FDD)
Based on the 2024 Burros Fries Franchise Agreement, the collective interest shared by Burros Fries, its franchisees, and other franchisees is establishing and operating a Burros & Fries restaurant that serves a variety of sandwiches, plates and salads and beverages (such as carbonated drinks, juices, teas and bottled water) for lunch and dinner and made fresh daily using proprietary recipes with an operational emphasis on quality and superior service. This uniform system, referred to as the "System," is designed to ensure consistency and quality across all Burros Fries locations. Franchisees may also sell novelty items and other products approved by Burros Fries, as well as offering catering services.
Burros Fries retains certain rights to protect the brand and system, including the right to operate or authorize others to operate businesses that are not substantially similar to a Burros & Fries Business, develop and sell Burros & Fries branded products through other channels, and develop other concepts or franchise systems. This allows Burros Fries to explore different business avenues without directly competing with its franchisees. Franchisees are required to maintain the confidentiality of proprietary information, including strategies for site acquisition, recipes, food preparation techniques, and other operational procedures, to protect the brand's competitive advantage.
To promote the Burros Fries mark, franchisees contribute to a System Advertising Fund, which Burros Fries uses for technology development, new product development, and national advertising programs. Burros Fries has sole discretion over these programs and is not obligated to spend more than the amount in the fund. Franchisees acknowledge that the success of their Burros Fries business depends on their personal efforts and is not guaranteed, and they confirm they have made an independent investigation of the opportunity before signing the Franchise Agreement. This shared interest in a uniform, quality-focused system, supported by advertising and protected proprietary information, aims to benefit both the franchisor and its franchisees.
