What This Means (2024 FDD)
According to Burros Fries's 2024 Franchise Disclosure Document, the company has invested considerable time in designing the decoration and outfitting of a Burros Fries Business, including specific kitchen equipment, furnishings, fixtures, décor items, and signage, which are considered part of their trade dress. Franchisees are required to purchase these items from Burros Fries, its affiliates, or approved vendors, as detailed in the Operations Manual and Section 12.T of the Franchise Agreement.
To maintain uniformity and quality, franchisees must lease or purchase all products, supplies, kitchen equipment, and services from approved sources. Burros Fries is not liable if these approved vendors cannot fulfill orders due to items being out-of-stock or discontinued. Franchisees are prohibited from buying or leasing from unapproved vendors without written consent from Burros Fries, which Burros Fries can either approve or deny within 30 days of a written request.
Burros Fries considers factors such as price, quality, design, safety, and the vendor's financial stability when approving vendors or suppliers. Failure to comply with these purchasing requirements may result in the termination of the Franchise Agreement. A typical Burros & Fries Business has approximately 2,500-3,000 square feet of space. The space must be enclosed and separate from other businesses with its own locking door. Franchisees must obtain written approval from Burros Fries before signing any lease or purchase agreement for the site.
