Unless we grant you prior approval, you must offer and sell products and services only onpremises from the BURNEY'S SWEETS & MORE Shop, and only in accordance with the requirements of the Franchise Agreement and the procedures set forth in the Brand Standards Manual. You must not offer or sell products or services through any other means or locations without our prior approval. For example, without prior approval, you may not sell goods by catering, mail order, catalog sales, computer, telemarketing, mobile application, internet sales, or delivery. You must only offer or sell products to retail customers for their use and consumption and not for resale. You may not advertise or market outside your Territory. We retain the right to control all online ordering.
The Shop is to be operated solely as a retail business. You shall have no right to sell your products or goods by mail order catalog sales, computer, telemarketing, mobile application, and/or internet marketing or by any other fashion other than sales to patrons at your specific business location or at approved off-site events.
While you have no rights to provide catering, delivery or online ordering services under the Franchise Agreement, we may permit you to provide such services.

What This Means (2025 FDD)
According to Burneys Sweets More's 2025 Franchise Disclosure Document, the franchisor retains the right to control all online ordering. This means that while a franchisee may be permitted to provide online ordering services, Burneys Sweets More maintains ultimate control over how these services are managed.
This control extends to the procedures established for online ordering, which may include additional reporting requirements for sales not captured by the franchisee's point-of-sale system. The franchisee must operate solely as a retail business from the Burneys Sweets More Shop, and cannot offer or sell products through online channels without prior approval from Burneys Sweets More.
This arrangement is fairly common in franchising, as franchisors often want to maintain brand consistency and control over the customer experience across all channels, including online ordering. It is important for prospective franchisees to understand that they will not have autonomy over online sales and must adhere to the franchisor's guidelines and systems. This also means that Burneys Sweets More is not obligated to compensate the franchisee for sales made inside or outside their territory if they decide to exercise their rights.
