If, to facilitate advertising and competitive strategies, we decide to implement a loyalty program, we reserve the right to require that you participate. You may be allowed or required to participate in these loyalty programs and other franchised locations may not. What This Means (2025 FDD)

According to Burneys Sweets More's 2025 Franchise Disclosure Document, Burneys Sweets More reserves the right to require franchisees to participate in a loyalty program. The decision to implement a loyalty program is at Burneys Sweets More's discretion. Burneys Sweets More also decides which franchised locations may or may not be required to participate in these loyalty programs. These decisions are based on what Burneys Sweets More determines is best for the franchise system and its brand.

This means that as a Burneys Sweets More franchisee, you may be obligated to participate in a loyalty program if Burneys Sweets More decides to implement one. However, participation may not be required for all franchisees, and the decision to include your location is solely at Burneys Sweets More's discretion.

This clause gives Burneys Sweets More significant control over marketing and customer engagement strategies, which can be both a benefit and a risk for franchisees. On one hand, it ensures a consistent brand image and potentially effective marketing campaigns. On the other hand, franchisees have limited control over these programs and must bear the costs of participation without necessarily seeing a direct return on investment. Prospective franchisees should inquire about the details of any existing or planned loyalty programs, including the costs, benefits, and criteria for participation.
