What This Means (2025 FDD)
According to Burneys Sweets More's 2025 Franchise Disclosure Document, Burneys Sweets More has the right to require franchisees to connect to its own computer systems.
Burneys Sweets More specifies that franchisees must purchase or lease and maintain computer hardware, software, mobile applications, cloud-based systems, robotics, automation equipment, smartphones, tablets, broadband internet, email, telephone and power lines, modems, printers, point-of-sale systems, scheduling systems, electronics, communication systems, customer management systems, instructional systems, robotics, automation, and other computer-related equipment. These systems are referred to as "Computer Systems" in the FDD. Burneys Sweets More can update these requirements as technology and industry standards change, potentially requiring franchisees to purchase or lease new systems at their own expense.
Franchisees may also be required to license proprietary Computer Systems directly from Burneys Sweets More or its affiliates and enter into license agreements with Burneys Sweets More or other suppliers to provide these systems. Burneys Sweets More and its agents have the right to access all information related to the operation of the shop that is accessed or stored on the Computer Systems, whether in-person or remotely, without the franchisee's consent, at any time and in any manner prescribed by Burneys Sweets More, including unlimited, remote, 24/7 access. Burneys Sweets More is also granted access to and may use data from the Computer Systems or any other source used by the franchisee, and the franchisee must furnish such data upon request.
Franchisees must provide Burneys Sweets More with all necessary passwords or login credentials to access the Computer Systems and grant any permissions needed for Burneys Sweets More to view and access the data. All data relating to the shop and/or the System that is generated by, stored on, saved to, downloaded or uploaded to, shared with the Computer Systems is part of the Franchised Business Data owned solely by Burneys Sweets More.
