What This Means (2025 FDD)
According to the 2025 Burneys Sweets More Franchise Disclosure Document, if a franchisee receives a notice of default, they have a minimum of fifteen days to cure the default. If the default is not curable, or if substantial action to cure the default has not been initiated within that 15-day period, Burneys Sweets More has the option to terminate the agreement with written notice to the franchisee.
This means that if Burneys Sweets More believes a franchisee is in breach of their agreement, they must provide written notice and allow the franchisee at least 15 days to correct the issue. This cure period allows the franchisee an opportunity to resolve the problem and avoid termination of the franchise agreement.
However, the 15-day cure period may not apply to all defaults. If Burneys Sweets More determines that the default is not curable, they can proceed with termination without waiting the full 15 days, provided they give written notice. It is important for a prospective franchisee to understand what constitutes a curable versus non-curable default under the Burneys Sweets More franchise agreement.
