What This Means (2025 FDD)
According to the 2025 Burneys Sweets More FDD, the franchise agreement emphasizes the importance of uniformity across all locations but does not guarantee it. The franchise agreement states that Burneys Sweets More has developed a unique system for its shops, highlighting the consistency and uniformity of products and services as distinguishing characteristics of the Burneys Sweets More system.
However, Burneys Sweets More does not fully guarantee complete uniformity across all locations. While franchisees are required to operate their shops in accordance with the Brand Standards Manual and Burneys Sweets More's standards and specifications, the franchisor does not warrant that other Burneys Sweets More shops will not solicit or make sales within a franchisee's territory. Franchisees acknowledge that they will compete with other Burneys Sweets More shops, which may be owned by the franchisor, its affiliates, or third parties, located near or adjacent to their territory.
This means that while Burneys Sweets More aims for uniformity, market dynamics and the actions of other franchisees or the franchisor can impact a franchisee's business. A prospective franchisee should consider that competition from other Burneys Sweets More locations is possible, and the franchisor does not have a duty to protect them from such competition.
