What This Means (2025 FDD)
According to Burneys Sweets More's 2025 Franchise Disclosure Document, a franchisee's territory does not include commercial kitchens. The FDD specifies that the franchisee's territory excludes several locations considered "Non-Traditional Locations."
These Non-Traditional Locations where Burneys Sweets More will not grant territorial exclusivity include enclosed malls, commercial kitchens, grocery stores, convenience stores, gas stations, hospitals, military installations, schools, airports, parks (including theme parks), sports arenas, traveling carts or food trucks, and similar venues. This means Burneys Sweets More retains the right to establish or license other businesses, including franchises, within these locations, even if they fall within the general territory granted to a franchisee.
For a prospective Burneys Sweets More franchisee, this exclusion means that the franchisor could potentially open another Burneys Sweets More location in a commercial kitchen within their territory. This could lead to increased competition and potentially impact the franchisee's sales. It is important for potential franchisees to consider the implications of these non-traditional locations and how they might affect their business.
