What This Means (2025 FDD)

According to the 2025 Burneys Sweets More Franchise Disclosure Document, franchisees are required to periodically update their Computer Systems. These updates must be done as required by Burneys Sweets More and/or the Computer Systems' suppliers, and the franchisee bears the expense of these updates. The Computer Systems include hardware, software, mobile applications, cloud-based systems, robotics, automation equipment, smartphones, tablets, internet service, email, telephone and power lines, modems, printers, point-of-sale systems, scheduling systems, electronics, communication systems, customer management systems, instructional systems, robotics, automation, and other computer-related or technology-related accessories.

Burneys Sweets More retains the right to update the requirements for the Computer Systems as they deem necessary to keep up with changing technology and industry standards. This may include requiring franchisees to purchase or lease new Computer Systems, also at the franchisee's expense. Burneys Sweets More and its agents have the right to access all information related to the operation of the shop that is accessed or stored on the Computer Systems, whether in-person or remotely, without the franchisee's consent. This access can be at any time and in any manner prescribed by Burneys Sweets More, including unlimited, remote, 24/7 access.

Franchisees are also responsible for the acquisition, operation, maintenance, and upgrading of the Computer Systems, as well as ensuring that the Computer Systems interface properly with Burneys Sweets More's and any third party's computer systems. The franchisee is responsible for any consequences resulting from the improper operation, maintenance, or upgrading of the Computer Systems. Franchisees are not allowed to install unauthorized software or make modifications to the Computer Systems that could interfere with their operation as required by Burneys Sweets More. Burneys Sweets More assumes no responsibility for any malfunction or "crash" of any Computer System, including any data lost as a result.
