What This Means (2025 FDD)

According to Burneys Sweets More's 2025 Franchise Disclosure Document, a franchisee must comply with the franchisor's instructions regarding Franchised Business Data. At Burneys Sweets More's request, the franchisee must immediately transfer all ownership interest in this data, adhering to all applicable laws. This stipulation ensures that Burneys Sweets More maintains control and ownership over critical business information generated by the franchise. Franchised Business Data is also considered Burneys Sweets More's property.

Upon termination, expiration, or non-renewal of the franchise agreement, the franchisee is obligated to return the Franchised Business Data to Burneys Sweets More. This includes ceasing all use of the data and delivering it back to the franchisor. Additionally, the franchisee must hand over all login credentials associated with any directories, marketing platforms, computer systems, online presences, and other accounts and systems affiliated with the Franchised Business.

This requirement is fairly standard in franchising, as customer data and business-related information are crucial assets. By retaining ownership and control of this data, Burneys Sweets More can ensure consistency across the brand and leverage the information for marketing, operational improvements, and strategic decision-making. Prospective franchisees should understand that they will not retain ownership of the data generated by their business and must comply with Burneys Sweets More's directives regarding its use and transfer.
