What This Means (2025 FDD)
According to Burneys Sweets More's 2025 Franchise Disclosure Document, if a franchisee overpays any amounts due, the overpayment will be credited to the franchisee's account. This credit becomes effective as of the first reporting date after both Burneys Sweets More and the franchisee determine that a credit is indeed due.
This means that if a franchisee mistakenly pays more than required in royalties, supplier fees, or any other fees, Burneys Sweets More will apply the excess amount as a credit towards the franchisee's future obligations. The timing of this credit depends on when both parties agree that an overpayment occurred, with the credit being applied from the next reporting date onwards.
Alternatively, Burneys Sweets More has the right to obtain gross sales information directly from the franchisee's point-of-sale system. This could potentially reduce discrepancies and overpayments, as Burneys Sweets More would have direct access to sales data for calculating fees. Franchisees should ensure accurate record-keeping and communication with Burneys Sweets More to facilitate the prompt identification and crediting of any overpayments.
