The franchisee-operated BURNEY'S SWEETS & MORE Shops included in this financial performance representation are substantially similar to the BURNEY'S SWEETS & MORE Shops for which we are offering franchises in this disclosure document, and their services and menus are substantially similar to those to be offered and sold by the BURNEY'S SWEETS & MORE Shop you would be purchasing, except that each of these shops sold some variation of items not on our standard menu, in addition to items on our standard Menu, including specialty coffee, ice cream, and breakfast and lunch food items. We anticipate that you, too, will choose to sell some variation of items not on our standard menu, but actual results may vary if you choose not to do so. We anticipate that your Shop will be located in a place with similar demographic and business conditions as the franchisee/licensee-operated BURNEY'S SWEETS & MORE Shops, but actual results will vary from franchisee to franchisee and from location to location. A new franchisee's results are likely to differ from the results shown in this Item because the locations in the Item have been in operation for over a year. We recommend that you make your own independent investigation to determine whether or not the franchise may be profitable, and consult with an attorney and other advisors prior to executing the franchise agreement.
