You may cancel this transaction, without penalty or obligation, within five business days from the above date. If you cancel, any payments made by you under the agreement, and any negotiable instrument executed by you will be returned within ten business days following the seller's receipt of your cancellation notice, and any security interest arising out of the transaction will be cancelled. If you cancel, you must make available to the seller at your business address all goods delivered to you under this agreement; or you may if you wish, comply with the instructions of the seller regarding the return shipment of the goods at the seller's expense and risk. If you do make the goods available to the seller and the seller does not pick them up within twenty days of the date of your notice of cancellation, you may retain or dispose of them without further obligation. If you fail to make the goods available to the seller, or if you agree to return them to the seller and fail to do so, then you remain liable for the performance of all obligations under this agreement. What This Means (2025 FDD)
According to the 2025 Burneys Sweets More FDD, a franchisee can cancel the franchise agreement within five business days of signing without penalty. To do so, the franchisee must mail or deliver a signed and dated copy of the cancellation notice, any other written notice, or send a telegram to DMG BURNEY INC. at 1107-C West Broad St. (P.O. Box 1450), Elizabethtown, North Carolina 28337. The FDD also lists the phone number 910-874-0874. The cancellation notice must be received by midnight on the date specified in the agreement.
If a franchisee cancels the agreement, Burneys Sweets More will return any payments made and any negotiable instruments executed by the franchisee within ten business days of receiving the cancellation notice. Additionally, any security interest arising from the transaction will be canceled. The franchisee must make available to Burneys Sweets More at the franchisee's business address all goods delivered under the agreement.
Alternatively, the franchisee can comply with Burneys Sweets More's instructions regarding the return shipment of the goods at Burneys Sweets More's expense and risk. If the franchisee makes the goods available and Burneys Sweets More does not pick them up within twenty days of the date of the cancellation notice, the franchisee may retain or dispose of them without further obligation. However, if the franchisee fails to make the goods available or agrees to return them but fails to do so, the franchisee remains liable for all obligations under the agreement.
