What This Means (2025 FDD)

According to Burger King's 2025 Franchise Disclosure Document, Burger King does not assist franchisees in negotiating the lease or purchase of the approved restaurant site. However, Burger King may provide development services for DTL (presumably company-owned) locations, which can include site acquisition, negotiation, permitting, zoning, or other related development services.

Before a franchisee can open a Burger King Restaurant, they must first have a specific location approved by Burger King. The franchisee is responsible for submitting a "Site Approval Package" that includes information on demographic characteristics, traffic patterns, proximity to existing restaurants, and the size and condition of the proposed premises. The package must also include a site sketch, aerial photos, signage, building placement, access and parking information, and evidence of the franchisee's ability to obtain property control, such as a letter of intent or option.

While Burger King does not negotiate leases or purchases for franchisees, they do provide access to a website where franchisees can download reproducible copies of standard architectural building plans and specifications for approved restaurant facilities. However, the franchisee is responsible for adapting these plans to comply with local building codes and legal requirements, resolving zoning issues, and obtaining the necessary permits. Burger King is not obligated to help franchisees conform the premises to local requirements or obtain required permits.

Prospective franchisees should be aware that site selection and acquisition are their responsibilities, and they should factor in the costs and time associated with these tasks when evaluating the Burger King franchise opportunity. It would be prudent for potential franchisees to inquire with Burger King about the scope of development services offered for DTL locations and whether any similar support could be extended to franchisees under certain circumstances.
