Can Buns On Fire permanently suspend my protected rights within the Protected Area?

According to the 2025 Buns On Fire Franchise Disclosure Document, Buns On Fire has the right to both temporarily and permanently suspend a franchisee's protected rights within their Protected Area under certain conditions. This action can be taken by Buns On Fire, at its sole discretion, if any events occur that would otherwise give them the right to terminate the Franchise Agreement. Buns On Fire must provide written notice to the franchisee before taking such action.

This clause in the franchise agreement means that a Buns On Fire franchisee's exclusive rights to their territory are not guaranteed. If the franchisee violates the agreement, Buns On Fire can reduce or eliminate the Protected Area, allowing them to establish or license other Buns On Fire restaurants in the vicinity. In addition to suspending protected rights, Buns On Fire has several other options it may elect to take without terminating the agreement, including temporarily removing information about the franchise from the system website, suspending participation in marketing programs, suspending services provided to the franchisee, suspending fee reductions, and suspending Buns On Fire's own obligations under the agreement. These actions, along with the suspension of protected rights, provide Buns On Fire with considerable latitude to address franchisee issues without resorting to full termination, but they also introduce a degree of uncertainty and risk for the franchisee.
