Franchisee agrees that Franchisor has the right, now or in the future, to purchase, merge, acquire or affiliate with an existing competitive or non-competitive franchise network, chain or any other business, regardless of the location of that chain's or business' facilities, and to operate, franchise or license those businesses and/or facilities as "Buns on Fire" operating under the Marks or any other marks following Franchisor's purchase, merger, acquisition or affiliation, regardless of the location of these facilities, except that if such businesses are located within any Protected Territory granted to Franchisee, those businesses will not change their names to "Buns on Fire".

What This Means (2025 FDD)
According to the 2025 Buns On Fire Franchise Disclosure Document, the franchisor has the right to purchase, merge, acquire, or affiliate with existing competitive or non-competitive franchise networks or other businesses. Following such actions, Buns On Fire can operate, franchise, or license these businesses under the "Buns on Fire" marks or any other marks. This applies regardless of the location of these facilities, except within a franchisee's protected territory, where the acquired businesses will not change their names to "Buns on Fire".
This clause provides Buns On Fire with significant flexibility in expanding its business through acquisitions and operating those acquired businesses under different brands. For a franchisee, this means that Buns On Fire could acquire a competing business and continue to operate it under its existing brand name, potentially even within the same general market area as the franchisee's location, provided it is outside the franchisee's protected territory. This could increase competition in the area.
Buns On Fire also retains the right to establish and operate Franchised Businesses and to use the Marks outside of Franchisee's Protected Territory, including, without limitation to establish and operate and granting others the rights to establishing and operating a Buns on Fire restaurant or other venues offering and selling premium halal cuisine and other identical, comparable, or related goods and services through the same, similar or dissimilar channels of distribution under trade and service marks other than the Marks and under any terms and conditions Franchisor deems appropriate at the sole discretion of the Franchisor; to produce, offer and sell, and granting others the rights to establishing and operating a Buns on Fire restaurant or other venue offering and selling premium halal cuisine and other identical, comparable, or related goods and services through the same, similar, or dissimilar channels of distribution under the Marks and under any terms and conditions the Franchisor deems appropriate at the sole discretion of the Franchisor.
