Any such delay shall extend performance only so long as such event is in progress except such Force Majeure Event will not affect or change Franchisee's obligation to pay Royalty Fees and National Branding & Marketing Fees when due.
Notwithstanding the foregoing, if there is a Force Majeure Event, Franchisor, may in its sole discretion, elect to waive the Royalty Fees and National Branding & Marketing Fees during the period of delay caused by the Force Majeure Event or such shorter period.
