What This Means (2025 FDD)
According to Buildingstars's 2025 Franchise Disclosure Document, there are currently no agreements in effect that significantly limit Buildingstars' rights to use or license its trademarks in any material manner. Buildingstars, Inc., an affiliate, owns the principal trademarks and service marks and has an agreement with BUILDINGSTARS that allows Buildingstars to use the marks and sublicense them to franchisees through the Franchise Agreement. The FDD states that should the agreement between BUILDINGSTARS and its Parent terminate, the Parent company will still honor the franchisee's rights to use the marks as outlined in the Franchise Agreement.
Buildingstars grants franchisees the right to operate their business under the "Buildingstars" name and may permit the use of other current or future marks. Franchisees must adhere to Buildingstars' rules when using the marks and cannot use unauthorized names, marks, designs, or symbols. They are also prohibited from using the marks in connection with the sale of unauthorized products or services without written authorization from Buildingstars.
Franchisees must immediately notify Buildingstars of any apparent infringement or challenges to the use of any mark. Buildingstars and its affiliates have the sole discretion to take action and control any litigation arising from such issues. Franchisees are required to assist in protecting Buildingstars' interests in any litigation or proceedings related to the marks. Buildingstars can modify or discontinue the use of the marks, and franchisees are obligated to comply with these changes at their own expense.
The trademark "BUILDINGSTARS" was registered on March 13, 2001, with the registration number 2435791. Buildingstars states that it is not aware of any superior prior rights or infringing uses that could materially affect a franchisee's use of the marks in any state.
