What This Means (2025 FDD)
According to the 2025 Buildingstars Franchise Disclosure Document, the gender or number of words used in the agreement does not affect its interpretation. The agreement states that all terms and words, regardless of number or gender, should be construed to include any other number (singular or plural) and any other gender (masculine, feminine, or neuter) as the context requires. This ensures that the agreement applies equally, no matter how the words are used.
Additionally, the FDD specifies that headings and paragraph titles are for reference only and do not define, limit, or extend the scope or intent of the agreement. This means that the actual content of the paragraphs, rather than their titles, determines the obligations and rights of both Buildingstars and the franchisee. Franchisees should focus on the substance of the provisions, not just the headings.
This clause is a standard legal provision intended to prevent disputes based on minor technicalities of language. It clarifies that the agreement should be interpreted based on its overall meaning and intent, rather than strict adherence to specific word choices or headings. Prospective Buildingstars franchisees can be confident that the agreement will be applied consistently regardless of such variations.
