Must a Buildingstars franchisee be capable of providing non-franchise services in a good and workmanlike manner?

Buildingstars Franchise · 2025 FDD

Answer from 2025 FDD Document

FRANCHISEE recognizes that it is not permitted to use the System or Marks in connection with the sale of any products or services other than the cleaning business.

If a Customer requests that FRANCHISEE render any services or sell any products that are not of the type that is normally rendered in connection with the System, FRANCHISEE must first notify BUILDINGSTARS and obtain approval from BUILDINGSTARS.

BUILDINGSTARS will not unreasonably object to FRANCHISEE'S request provided that the services do not interfere with the services that FRANCHISEE renders in connection with the franchise, the services and products are in no way associated with the Marks and System, FRANCHISEE is capable of providing the products and services in a good and workmanlike manner, and the Customer is fully apprised that the services or products are not being rendered in connection with the franchise.

BUILDINGSTARS retains the right to object to any future

requests and the failure to object to any request shall not prohibit BUILDINGSTARS from objecting to any future requests.

What This Means (2025 FDD)

According to Buildingstars's 2025 Franchise Disclosure Document, a franchisee may be required to provide services or sell products that are not normally part of the Buildingstars system, but only with prior approval from Buildingstars. Buildingstars will not unreasonably object to such a request as long as the additional services do not interfere with the core franchise operations, are not associated with the Buildingstars brand, and the franchisee is capable of performing these services in a good and workmanlike manner. Additionally, the customer must be fully aware that these additional services are separate from the Buildingstars franchise.

This requirement ensures that Buildingstars franchisees maintain a standard of quality even when offering services outside the scope of the franchise agreement. It also protects the Buildingstars brand by ensuring that any additional services offered by franchisees are clearly distinguished from the core cleaning services provided under the Buildingstars name.

Buildingstars retains the right to object to any future requests for non-franchise services, and a failure to object to a request does not prevent Buildingstars from objecting to future requests. This clause gives Buildingstars ongoing control over the types of services its franchisees offer, even if those services are outside the scope of the standard franchise agreement. This protects the brand's reputation and ensures consistency across all franchise locations.
