  • (10) Landlord acknowledges and agrees that: (a) Franchisor is a third party beneficiary under the Lease pursuant to the terms of this Addendum; (b) Franchisor is at all times entitled to enforce, in its own name, the provisions of this Addendum; and (c) Landlord waives any limitation in the Lease that would prevent Franchisor or its designated assignee, sublessee or franchisee from operating a Buff City Soap makery at the Premises or within a specified distance of the Premises. Each of Landlord and Franchisee hereby waives any objection or challenge to Franchisor's right to enforce the provisions of this Addendum.

Without limiting any provision of this Agreement, you and Employer recognize and agree that Franchisor is a third party beneficiary of this Agreement, and at all times during and after your employment with Employer, Franchisor will have the independent right to enforce the terms of this Agreement.
