  • (d) "Applicable Law" means any federal, state, and local laws, ordinances, and codes, together with all rules, regulations, policies, and guidelines related thereto, applicable to the subject matter of this Agreement and either Party, including the development, construction and/or operation of the Makery pursuant to the terms hereof, including, without limitation, all laws and regulations related to cosmetics (e.g.

Food & Drug Administration packaging and labeling requirements); environmental regulations (e.g. regulations applicable to the disposal of containers used in the storage of lye and similar component ingredients); labor; consumer privacy and data security; and those governing public accommodations for persons with disabilities.

Buff City Soap also has the right to make decisions and take actions that may affect the franchisee's interests, as long as these actions are consistent with the franchisee's explicit rights and obligations under the agreement or Applicable Law. However, Buff City Soap has no obligation to ensure that the Makeries are developed and operated in accordance with Applicable Law and will have no liability if the franchisee's development violates Applicable Law.
