What This Means (2025 FDD)
According to the 2025 Buff City Soap Franchise Disclosure Document, the Brand Fund Contribution can be found on the Summary Page. Specifically, the Brand Fund Contribution is listed as 2% of Net Sales. Additionally, franchisees must make a Local Marketing Expenditure, which when combined with the Brand Fund Contribution, will not exceed 4% of Net Sales during the Initial Term of the Franchise Agreement. The initial Local Marketing Expenditure is set forth as 1% of Net Sales on the Summary Page.
Buff City Soap uses the Brand Fund for marketing, advertising, and related programs, including digital, print, Internet, and Social Media, as well as the planning and purchasing of national, regional, and/or local advertising. The franchisor has the option to increase the Brand Fund Contribution with 60 days' prior notice, but such increase will not exceed the 4% limit when combined with the Local Marketing Expenditure.
The Brand Fund is maintained separately from Buff City Soap's other funds and will not be used for general operating expenses, except for reasonable salaries, administrative costs, travel expenses, and overhead related to the Brand Fund's administration. The Brand Fund operates as a conduit for collecting and expending contributions, and Buff City Soap does not act as a trustee or have a fiduciary duty to franchisees regarding the Brand Fund's operation.
Prospective franchisees should note that Buff City Soap may spend more or less than the aggregate contributions to the Brand Fund in any fiscal year and may borrow or invest surpluses. Franchisees can request a copy of the unaudited annual statement of monies collected and costs incurred by the Brand Fund, but no more than once annually.
