What This Means (2025 FDD)
According to Buff City Soap's 2025 Franchise Disclosure Document, the definition of "Applicable Law" does include guidelines. The document specifies that "Applicable Law" encompasses federal, state, and local laws, ordinances, and codes, along with all associated rules, regulations, policies, and guidelines. This broad definition extends to the subject matter of the franchise agreement and applies to both parties involved.
For a prospective Buff City Soap franchisee, this means they must adhere to a wide range of legal requirements and guidelines during the development, construction, and operation of their Makery (store). These include, but are not limited to, laws and regulations related to cosmetics, such as U.S. Food & Drug Administration packaging and labeling requirements, environmental regulations concerning the disposal of containers used for storing lye and similar ingredients, labor laws, consumer privacy and data security regulations, and laws governing public accommodations for individuals with disabilities.
The inclusion of "guidelines" within the definition of Applicable Law suggests that franchisees must stay informed about and comply with not only mandatory legal requirements but also recommended best practices and industry standards. This could potentially increase the complexity and cost of operating a Buff City Soap franchise, as franchisees may need to invest in training, consulting, and compliance measures to ensure they are meeting all applicable standards.
It is important for prospective franchisees to carefully review all relevant federal, state, and local laws, ordinances, codes, rules, regulations, policies, and guidelines to fully understand their obligations and responsibilities. They should also consult with legal and business professionals to ensure they are in compliance with all Applicable Laws.
