ACQUISITION OF EQUIPMENT

    1. Except as provided in Article IV.2. above, Licensee, at its own expense, will acquire, install and maintain, all on-site computer/terminal equipment, computer/terminal interconnections, modems, controllers and other communication equipment, interconnections and services, including an ISP if Licensee elects to connect to the System via the Internet, backup capabilities and materials it may require from time to time in order to access and utilize the System (hereinafter, either individually or collectively, the "Equipment").

According to Budget's 2025 Franchise Disclosure Document, the franchisee is generally responsible for acquiring, installing, and maintaining all on-site computer equipment. Specifically, Budget franchisees, at their own expense, must acquire, install, and maintain all on-site computer/terminal equipment, computer/terminal interconnections, modems, controllers, and other communication equipment needed to access and utilize the Budget system. This includes securing an Internet Service Provider (ISP) if the franchisee chooses to connect to the system via the internet, as well as providing backup capabilities and materials.

To ensure compatibility with Budget's system, all equipment must be approved by ABCR before installation and must be on ABCR's approved equipment list. The franchisee is also responsible for preparing each site for equipment installation according to ABCR's guidelines. While ABCR may offer assistance during the acquisition and installation phases by providing system compatibility standards to the franchisee's vendors, the ultimate responsibility for proper equipment and its maintenance lies with the franchisee.

The Budget franchisee is responsible for ensuring their personnel receive adequate training to properly operate the equipment and utilize the system. Budget offers system training and on-site assistance for an additional charge. If a franchisee uses unapproved equipment or fails to maintain and operate equipment as required, they will be held responsible for any resulting damage or expenses incurred by ABCR and other users of the system. ABCR also has no obligation to perform under the agreement if non-approved equipment is used. The franchisee is responsible for correcting any nonconformity at their own expense as specified by ABCR.
