What This Means (2025 FDD)
According to the 2025 Brueggers Bagels Franchise Disclosure Document, if the premises of a Brueggers Bagels location are damaged or destroyed, and repairs or reconstruction cannot be completed within 60 days due to an event that is no fault of the franchisee, the franchisee has 30 days after the event to apply for Brueggers Bagels' approval to relocate and/or reconstruct the Bakery. Approval for relocation or reconstruction will not be unreasonably withheld by Brueggers Bagels.
This clause protects the franchisee from being penalized for circumstances beyond their control, such as natural disasters or accidental damage to the property. It allows the franchisee a reasonable timeframe to seek approval for either rebuilding at the same location or finding a new location, ensuring they can continue operating their Brueggers Bagels franchise.
It is important to note that the franchisee must actively seek approval within the specified timeframe. Failure to do so could result in the termination of the franchise agreement. Additionally, while Brueggers Bagels will not unreasonably withhold approval, the final decision rests with them, and franchisees should be prepared to present a solid case for relocation or reconstruction.
