What This Means (2025 FDD)

According to Brueggers Bagels's 2025 Franchise Disclosure Document, if a franchisee purchases a Brueggers Bagels franchise in Washington, the arbitration or mediation site will be in the state of Washington. However, the location could also be a place mutually agreed upon at the time of the arbitration or mediation. The arbitrator or mediator can also determine the location at the time of arbitration or mediation.

This stipulation is part of the Washington Addendum to the Franchise Agreement, acknowledging the Washington Franchise Investment Protection Act. This ensures that franchisees in Washington are not forced to arbitrate or mediate disputes in locations that are unduly burdensome or unfair.

This clause provides flexibility while also protecting the franchisee's rights under Washington law. It allows for arbitration or mediation to occur in Washington, but also provides options for a mutually agreeable location or a location determined by the arbitrator or mediator, which could potentially save on travel costs and other expenses for the franchisee.
