Does Brueggers Bagels' approval of a lease guarantee the suitability of the location?

- 6.3.1. That our review and approval of a site, lease, sublease, design plans or renovation plans for the Bakery do not constitute a recommendation, endorsement, or guarantee of the suitability of that location or the terms of the lease, or sublease, or purchase agreement.
You agree that you will take all steps necessary to determine for yourself whether a particular location and the terms of any lease, sublease, or purchase agreement for the site are beneficial and acceptable to you.
- 6.3.2. That no matter to what extent (if any) that we participate in lease negotiations, discussions with the landlord, and/or otherwise in connection with reviewing the lease, you have to make the final decision as to whether or not the lease is sensible for your business, and the final decision as to whether or not to sign the lease is yours, and you agree not hold us responsible with respect to the terms and conditions of your lease.

According to Brueggers Bagels' 2025 Franchise Disclosure Document, the franchisor's approval of a site, lease, sublease, design plans, or renovation plans for the Bakery does not constitute a recommendation, endorsement, or guarantee of the suitability of that location or the terms of the lease, sublease, or purchase agreement. The review conducted by Brueggers Bagels is solely for their benefit.
Brueggers Bagels emphasizes that the franchisee must take all necessary steps to determine whether a particular location and the terms of any lease, sublease, or purchase agreement for the site are beneficial and acceptable to them. Even if Brueggers Bagels participates in lease negotiations or discussions with the landlord, the franchisee has to make the final decision as to whether or not the lease is sensible for their business and whether or not to sign the lease.
Therefore, the franchisee agrees not to hold Brueggers Bagels responsible with respect to the terms and conditions of their lease. The franchisee acknowledges bearing primary responsibility for selecting the site and negotiating the terms and conditions of their leases, subleases, or purchase agreements for the site.
