What This Means (2025 FDD)
According to the 2025 Brueggers Bagels Franchise Disclosure Document, if you create any adaptation, translation, or derivative works related to the franchise, you must submit them to Brueggers Bagels for approval before you use them. This requirement ensures that all materials associated with the Brueggers Bagels brand maintain consistency and adhere to the franchisor's standards.
Furthermore, any such material, including posters or websites, becomes the property of Brueggers Bagels, regardless of whether the adaptation was authorized. As a franchisee, you agree to assign all rights, titles, and interests in these materials to Brueggers Bagels or their designee. You must also execute any documents that Brueggers Bagels deems necessary to reflect or perfect their ownership of these materials.
This policy is typical in franchising, as franchisors need to protect their brand identity and ensure consistent messaging across all franchise locations. By retaining ownership of derivative works, Brueggers Bagels maintains control over how its brand is represented and can prevent unauthorized or inconsistent use of its intellectual property. Prospective franchisees should be aware of this requirement and factor it into their plans for marketing and promotional activities.
