Answer from 2025 FDD Document

Under the Franchise Agreement Brown grants you the right to operate a BROWN'S Store at a specific location. You will receive an exclusive territory (the "Territory") that will consist of the geographic area that is within a 5-mile radius (as the crow flies) of your Store, unless you are

located in a shopping mall food court in which event you will not receive an exclusive territory.

What This Means (2025 FDD)

According to Browns Chicken's 2025 Franchise Disclosure Document, a franchisee will not receive an exclusive territory if their Browns Chicken store is located in a shopping mall food court.

Typically, franchises offer an exclusive territory to protect franchisees from direct competition from other units of the same brand. This exclusivity helps franchisees build their customer base and maximize their revenue potential within a defined geographic area. However, in the specific case of Browns Chicken stores located in shopping mall food courts, this protection is not provided.

The absence of an exclusive territory in a shopping mall food court setting means that Browns Chicken retains the right to open additional franchised or company-owned stores within the same food court or nearby. This could lead to direct competition between Browns Chicken units, potentially impacting the sales and profitability of individual franchisees. Prospective franchisees should carefully consider this factor and evaluate the potential for competition within the food court environment before investing in a Browns Chicken franchise at such a location.

It is important for potential Browns Chicken franchisees to fully understand the implications of not having an exclusive territory, especially in high-traffic locations like shopping mall food courts. They should inquire about Browns Chicken's strategy for managing potential competition and assess the potential impact on their investment.
