What This Means (2025 FDD)
According to Browns Chicken's 2025 Franchise Disclosure Document, a franchisee must have a license to sell alcoholic beverages in order to obtain and maintain a video gaming license. This requirement is part of the additional restrictions set forth in Rider G to the Franchise Agreement, known as the Video Gaming Rider.
This means that if a Browns Chicken franchisee wishes to offer video gaming at their store, they must first secure a valid liquor license. This prerequisite ensures compliance with regulations related to video gaming establishments, particularly concerning age restrictions and responsible alcohol service. The franchisee is also restricted from selling alcoholic beverages to and from allowing access to the video gaming area of their store for persons under 21 years of age.
Furthermore, the franchisee must also obtain a license as a Licensed Establishment from the Illinois Gaming Board, referred to as the "State License", as required by Section 45 of the Act, and must obtain renewals of its State License annually or at such other intervals as required by the Act. If applicable, the franchisee must also obtain a license or permit from the municipality in which the Browns Chicken store is located, to offer Video Gaming, and shall obtain renewals of its Municipal License or Permit annually or at such other intervals as required by said municipality.
This requirement highlights the importance of understanding and adhering to local and state regulations when operating a Browns Chicken franchise, especially when incorporating additional revenue streams like video gaming. Franchisees should consult with legal counsel to ensure they meet all necessary licensing and operational requirements.
