What This Means (2025 FDD)
According to the 2025 Browns Chicken Franchise Disclosure Document, a franchisee must open their store for business within 15 days after the later of two conditions: Browns Chicken determines the store is in suitable condition, and the franchisee completes their initial training. The franchisee has a maximum of 300 days from the date of the Franchise Agreement to open the store. Failure to open the store within this timeframe constitutes a material default and may result in the termination of the Franchise Agreement by Browns Chicken.
In addition to the store opening timeline, Browns Chicken requires franchisees to hire all store employees and be responsible for their employment terms and compensation. Franchisees must implement a training program for their employees that aligns with Browns Chicken's training standards and procedures. Franchisees must maintain a staff of trained employees sufficient to operate the store according to the Franchise Agreement, including at least two full-time managers and one part-time manager. Franchisees cannot employ individuals who fail or refuse to complete the required training program. All employees must maintain a neat and clean appearance and adhere to Browns Chicken's specified dress and uniform standards.
Browns Chicken also mandates that franchisees clearly communicate to their employees that they (the franchisee) are the employer, not Browns Chicken. Employment applications must include the statement: "You are applying for a job to work for an independently owned Franchisee and not for the Franchisor." This requirement aims to avoid any confusion regarding the employer-employee relationship and ensure compliance with labor laws.
