According to Browns Chicken's 2025 Franchise Disclosure Document, upon the execution of the Preliminary Agreement, Browns Chicken will furnish the prospective franchisee with written criteria for site selection. These materials must be returned to Browns Chicken upon termination of the agreement.

It is the prospective franchisee's responsibility to locate a site suitable for a Browns Chicken store within an area agreed upon with Browns Chicken, typically within 60 days. However, the area is not exclusive or protected, meaning Browns Chicken can grant a franchise to another party within the same area. If Browns Chicken does grant a franchise to another party in the area during the term of the agreement, the prospective franchisee may terminate the agreement and obtain a refund of their deposit.

Browns Chicken will not unreasonably withhold approval of sites that meet its standards for general location, physical and demographic characteristics, traffic patterns, parking, competition, proximity to other businesses (including other Browns Chicken stores), the nature of other businesses nearby, layout, physical characteristics, rental costs, lease duration, and other lease terms. However, Browns Chicken's approval of a site does not constitute a representation or warranty of its suitability for a Browns Chicken store or any other purpose; it only indicates that the site falls within Browns Chicken's acceptable criteria at the time of evaluation.
