Brown will from time to time with the assistance of a local advertising agency, formulate, develop, produce and conduct regional advertising and promotion programs in such form and media as Brown determines, in its sole discretion, to be most effective.
Brown will direct all advertising programs financed by the Advertising Fund, with sole discretion over the creative concepts, materials, and endorsements used therein, and the geographic, market, and media placement and allocation thereof. There is no advertising council in connection with this Franchise. The Advertising Fund may be used to meet any and all costs of formulating, administering, maintaining, directing, preparing and producing regional, multi-regional or local advertising materials, programs and public relations activities, including, without limitation, the cost of producing video, audio and written advertising materials; administering multi-regional advertising programs; purchasing trade journal, direct mail and other media advertising; and employing advertising agencies; supporting public relations, market research and marketing activities; and providing advertising and marketing materials and menus to BROWN'S Stores. According to the 2025 Browns Chicken Franchise Disclosure Document, Browns Chicken does not have an advertising council. Browns Chicken, with the assistance of a local advertising agency, formulates, develops, produces, and conducts regional advertising and promotion programs. Browns Chicken has sole discretion over the advertising programs financed by the Advertising Fund, including creative concepts, materials, endorsements, and the geographic, market, and media placement and allocation.
The Advertising Fund is used to cover the costs of creating, managing, and producing advertising materials, programs, and public relations activities. This includes video, audio, and written advertising materials, multi-regional advertising programs, trade journal advertising, direct mail, employing advertising agencies, market research, and providing advertising and marketing materials and menus to Browns Chicken stores. The Advertising Fund may also sponsor a Super Cup driver, whose car displays Browns Chicken trademarks and product pictures.
Franchisees are required to pay 4% of their gross sales to the Advertising Fund, which Browns Chicken manages. While Browns Chicken aims to maximize recognition of the brand and patronage of Browns Chicken stores, it is not obligated to ensure that advertising expenditures in any area are proportionate to the contributions from Browns Chicken stores in that area. Browns Chicken does not have a fiduciary obligation to franchisees regarding the Advertising Fund's establishment, collection, control, or administration of monies.
