Additionally, your Agency must be under your designated Control Person's direct supervision. You (or, if you are an Entity, your owner) must be the Control Person. You must seek our approval if you want the Control Person to be someone other than you (or your owner) during the Initial Term. Your Control Person must meet our then-current Control Person standards and requirements, including (1) to live within one-hour drive-time from the Protected Territory and (2) to be in the office, or at minimum in the Protected Territory, on a daily full-time basis, and as otherwise defined in Exhibit K to this Agreement.

What This Means (2025 FDD)
According to Brightstar Care's 2025 Franchise Disclosure Document, the Control Person is responsible for the direct supervision of the Brightstar Care agency. If the franchisee is an individual, they must serve as the Control Person. If the franchisee is a business entity, one of the owners must fill this role. Should the franchisee wish to appoint someone else as the Control Person during the initial term of the agreement, they must seek approval from Brightstar Care.
The Control Person must meet Brightstar Care's standards, which include living within a one-hour drive of the protected territory. Additionally, the Control Person is required to be present in the office or, at a minimum, within the protected territory on a daily, full-time basis. Exhibit K of the Franchise Agreement further defines the standards for the Control Person.
Failure to have the agency under the direct supervision of a designated Control Person, appointing a replacement without prior approval or notice, or having a replacement Control Person who does not meet Brightstar Care's standards can result in a breach of the franchise agreement. This could potentially lead to termination of the agreement if the issues are not resolved.
