What This Means (2025 FDD)
According to the 2025 Brightstar Care FDD, the software warranty does not cover issues arising from the franchisee's actions (or inaction), the actions of others, or events that are outside of Microsoft's control. This means that if a problem with the software is caused by something the franchisee does, or by a third party, or by an event like a natural disaster, the warranty will not apply.
This exclusion is fairly standard in software warranties. It is designed to protect Microsoft from being held responsible for problems that are not caused by defects in the software itself. For a Brightstar Care franchisee, this means it's important to ensure that they and their staff are properly trained on how to use the software, and that they take steps to protect their systems from external threats like viruses and hackers.
It is important to note that this exclusion applies "to the extent permitted by law", meaning that some jurisdictions may offer consumer rights that supersede this exclusion. Franchisees should consult with legal counsel to understand their rights in their specific location.
