- (a) The Initial Franchise Fee is nonrefundable. The Initial Franchise Fee is due and payable in full no later than the date you sign this Agreement.

What This Means (2025 FDD)
According to Brightstar Care's 2025 Franchise Disclosure Document, the initial franchise fee is due in full when you sign the franchise agreement. The FDD specifies that the initial franchise fee is nonrefundable. However, this fee may not apply if you are executing the agreement for a renewal term or if the agency operating under the agreement was acquired as a result of a transfer.
Brightstar Care may terminate the agreement and retain all fees paid if the franchisee (or its key personnel) does not satisfactorily complete the required Pre-Opening Training, Boot Camp Training, or fails to meet the milestones within the BrightStart program's required timeframe.
There is a potential discount on the Initial Franchise Fee. If you are in compliance with the agreement, your agency has been open for at least 12 months, and your agency meets Brightstar Care's then-current expansion requirements, you may receive a 10% discount on the Initial Franchise Fee for an additional franchise. This discount does not apply to Medium Density Market agencies.
