- Your failure to secure a site for the Agency within the time required in Paragraph 1 will constitute a default under the Agreement and this Site Selection Addendum. Time is of the essence.

- Before you secure a site for the Agency, you must submit to us, in the form we specify, such information or materials we may reasonably require and a letter of intent or other evidence satisfactory to us confirming your favorable prospects for obtaining the proposed site.

What This Means (2025 FDD)
According to Brightstar Care's 2025 Franchise Disclosure Document, before a franchisee secures a site for their Agency, they must submit information or materials that Brightstar Care may reasonably require, in a specified form. Additionally, the franchisee needs to provide a letter of intent or other evidence that Brightstar Care finds satisfactory, confirming favorable prospects for obtaining the proposed site.
Brightstar Care maintains approval rights over the site, even if an affiliate of the franchisee intends to purchase and own the site. Brightstar Care must pre-approve the proposed site. The franchisee is required to lease the site from a third party, whether or not that third party is affiliated with the franchisee.
Failure to secure a site within the timeframe outlined in the Site Selection Addendum constitutes a default under the Agreement. Brightstar Care emphasizes that time is of the essence in this process.
