Brightstar_Care Franchise · 2025 FDDAnswer from 2025 FDD Document
You must seek our approval if you want the Control Person to be someone other than you (or your owner) during the franchise term. Prior to there being any change to your designated Control Person, you must give us advance written notice and obtain our approval of this change, and we must confirm that your proposed replacement Control Person meets our then-current Control Person standards and requirements.

What This Means (2025 FDD)
According to Brightstar Care's 2025 Franchise Disclosure Document, a franchisee must take specific steps before changing the designated Control Person. The franchisee is required to provide advance written notice to Brightstar Care regarding the intended change. Furthermore, the franchisee must obtain Brightstar Care's approval for the new Control Person. Brightstar Care will then confirm whether the proposed replacement meets the company's then-current standards and requirements for the Control Person role.
These requirements are in place to ensure that the Brightstar Care agency continues to be managed by a qualified individual who meets the franchisor's standards. The Control Person is a critical role, responsible for the day-to-day operations and general management of the agency. They also have the authority to sign contracts on behalf of the franchise. Therefore, Brightstar Care retains the right to approve any changes to this position to protect the brand and maintain operational consistency across all franchise locations.
Failure to comply with these requirements can result in serious consequences for the Brightstar Care franchisee. Specifically, designating a replacement Control Person without prior written notice and approval from Brightstar Care, or if the replacement does not meet the required standards, constitutes a default under the Franchise Agreement. If such a default occurs, Brightstar Care has the right to terminate the Franchise Agreement after providing written notice and a 15-day opportunity to correct the issue. This highlights the importance of adhering to the franchisor's procedures for Control Person changes to avoid potential termination of the franchise agreement.
