What This Means (2025 FDD)
According to Brain Balance's 2025 Franchise Disclosure Document, franchisees face specific restrictions regarding the use of individual names in printed and electronic advertising.
The Brain Balance franchise agreement stipulates that franchisees cannot display the name of any individual, employee, officer, or other person in any printed or electronic advertising without adhering to certain conditions. First, any individual's name must always be accompanied by the words "Brain Balance®" or "Brain Balance Program®." Second, the name can appear no more than once in the advertisement. Third, the name's font size is restricted to a maximum of one agate line in newspaper and magazine ads and two agate lines in other advertising or stationery, with the exception of business cards. Finally, the name cannot be printed in a font that is larger or bolder than the words "Brain Balance®" or "Brain Balance Program.®"
These restrictions are designed to protect Brain Balance's brand identity and ensure consistent marketing practices across all franchise locations. By controlling the use of individual names in advertising, Brain Balance aims to maintain a uniform brand image and prevent any single individual from overshadowing the brand itself. This also ensures that the focus remains on the Brain Balance program and its benefits, rather than on individual staff members.
A prospective Brain Balance franchisee should carefully review these restrictions and ensure they can comply with them in all their advertising and promotional materials. Failure to adhere to these guidelines could result in a breach of the franchise agreement.
