Can Brain Balance modify the Brain Balance Program?

According to Brain Balance's 2025 Franchise Disclosure Document, Brain Balance has the right to modify the Brain Balance Program and the Operations Manual based on research and other developments. As a franchisee, you must abide by any additions, deletions, and modifications that Brain Balance makes.

However, there is a limitation to Brain Balance's right to make changes. These changes must not materially and unreasonably increase your obligations under the Franchise Agreement. This clause provides some protection to the franchisee, ensuring that modifications to the program or manual do not place undue burden or cost on the franchisee's operations.

This flexibility allows Brain Balance to adapt its program based on new research or industry best practices, which can be a benefit. However, franchisees should pay attention to any proposed changes and assess whether they could lead to increased costs or operational challenges. It would be prudent for a prospective franchisee to discuss with existing franchisees how Brain Balance has historically implemented changes and what impact those changes had on their businesses.
